Recently the number of medical malpractice sues are increasing but the existing criteria for judgement are still vague and the criteria and limitation has been only known through judicial reports. But still the judicial reports are not open to medical practitioners or common people and are only limited to those who has interest in them. The author has reviewed malpractice judicial reports especially the civil cases, from late 1980´s to the recent. The judgemental criteria and its limitation are analyzed from the legal perspective, and through the process of medical practice and its fields. To judge fairly on medico-legal cases, and objective impartial system for such judgement is mandatory.
